These Terms of Service ("Terms") govern your access to and use of the WingMate mobile application ("App") and related services operated by Kennily ("we", "our", or "us"). Please read these Terms carefully before using WingMate.
1 Acceptance of Terms
By downloading, installing, or using the WingMate App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.
Your continued use of the App following any updates to these Terms constitutes your acceptance of the revised Terms.
2 Description of Service
WingMate is a duty swap management tool designed for airline crew members. The App provides the following features:
- A digital platform to enter and manage your duty roster
- An automated matching service to identify crew members with compatible duties for a potential swap
- In-app messaging to facilitate communication between matched crew members
- Listing and candidate management tools for organising swap requests
3 Eligibility
To use WingMate, you must:
- Be at least 18 years of age
- Be an active or recently active airline crew member
- Have a valid Google account for authentication
- Agree to and comply with these Terms
By using the App, you represent and warrant that you meet all eligibility requirements. We reserve the right to suspend or terminate accounts that do not meet these requirements.
4 User Account and Responsibilities
Account Security
Your account is authenticated through Google Sign-In. You are responsible for maintaining the security of your Google account. Notify us immediately at support@wingmates.club if you believe your account has been compromised.
Accuracy of Information
You are responsible for ensuring that all duty schedule data, rank information, and preferences you enter into the App are accurate and up to date. Inaccurate data may result in poor matching results and inconvenience to other crew members.
Professional Conduct
When communicating with other crew members through the App's messaging feature, you agree to:
- Behave professionally and respectfully at all times
- Not harass, threaten, or engage in any abusive behaviour toward other users
- Not impersonate any person or misrepresent your identity or rank
5 Acceptable Use
You agree to use WingMate only for its intended purpose of facilitating duty swap coordination. You must not:
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations
- Submit false, misleading, or fabricated duty schedule information
- Attempt to manipulate matching results in a dishonest manner
- Use automated scripts, bots, or other automated means to access or interact with the App
- Attempt to reverse engineer, decompile, or extract source code from the App
- Interfere with or disrupt the integrity or performance of the App or its servers
- Access another user's account without authorisation
- Use the App to collect personal information about other users beyond what is displayed for swap matching purposes
We reserve the right to suspend or terminate access for any user who violates these acceptable use rules.
6 Disclaimer of Liability for Duty Swap Outcomes
All duty swap arrangements facilitated through WingMate are solely between the participating crew members and must comply with the rules, regulations, and collective agreements of the relevant airline. WingMate does not act as an intermediary, agent, or guarantor of any swap transaction.
Users are strongly encouraged to confirm all swap arrangements through their airline's official scheduling or crew management systems before treating any swap as confirmed.
7 Intellectual Property
The WingMate App, including its design, code, algorithms, branding, and content, is owned by Kennily and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App solely for your personal, non-commercial use in accordance with these Terms.
You may not copy, modify, distribute, sell, or sublicense any part of the App or its content without our prior written consent.
You retain ownership of any duty schedule data and personal information you input into the App. By submitting data to WingMate, you grant us a limited licence to process and display that data as necessary to provide the matching and messaging services.
8 Account Termination
Termination by You
You may delete your account at any time through the App's settings or by contacting us at support@wingmates.club. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
Termination by Us
We reserve the right to suspend or permanently terminate your account, with or without notice, if we determine that you have:
- Violated these Terms or our Privacy Policy
- Engaged in fraudulent, abusive, or harmful behaviour toward other users
- Submitted materially false or misleading information
- Acted in a manner that may cause legal liability for us or other users
In cases of severe violations, we may take immediate action including permanent bans without prior notice. If you believe your account was terminated in error, please contact us at support@wingmates.club.
Effect of Termination
Upon termination of your account, your right to access the App ceases immediately. Any active listings will be removed. We will process data deletion in accordance with our Privacy Policy.
9 Limitation of Liability
To the maximum extent permitted by applicable law, Kennily and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the App.
This includes, without limitation, damages for:
- Loss of data or duty schedule information
- Failed or cancelled duty swap arrangements
- Actions taken by your airline in relation to any swap
- Service interruptions or technical failures
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
10 Changes to Terms
We may revise these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Notify active users via an in-app notification or push notification
Changes take effect immediately upon posting unless otherwise stated. If you do not agree to the updated Terms, you must stop using the App and may request account deletion. Continued use after the effective date of any changes constitutes acceptance of the revised Terms.
11 Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the applicable jurisdiction.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
